5. MORTGAGE INQUIRIES AND HUMAN FOLLOW-UP
When you submit a mortgage inquiry, TMF may use an automated conversational tool provided through HubSpot to ask a limited number of basic questions as an initial screening step. This automated interaction is used to collect and organize information for follow-up; it does not by itself constitute a final loan approval, denial, underwriting determination, or other binding credit decision.
After the initial screening, a member of the TMF team and/or a licensed Mortgage Loan Originator, as applicable, may contact you directly to discuss your inquiry and next steps.
6. LEAD INFORMATION AND THIRD-PARTY DISCLOSURES
TMF does not sell, rent, or transfer mortgage leads to third parties for their own lead-generation or marketing purposes. A mortgage inquiry submitted to TMF is intended to remain within TMF for follow-up and servicing of the inquiry.
We may disclose personal information to service providers and other parties when reasonably necessary to operate our business, provide requested services, comply with law, protect our rights, or support the purposes described in this Policy. These parties may include technology, CRM, hosting, security, analytics, advertising, communications, professional, and other business service providers.
We may also disclose information when required by law, regulation, legal process, court order, subpoena, government request, or to prevent fraud, security incidents, or other harm.
7. HUBSPOT
TMF uses HubSpot as a customer relationship management (CRM) and website/conversational technology platform. Information you submit through TMF forms or the website chatbot may be processed and stored in HubSpot on TMF’s behalf. HubSpot may act as a service provider or processor when it processes personal data for TMF.
HubSpot’s privacy practices are described in its Privacy Policy: https://legal.hubspot.com/privacy-policy.
8. COOKIES, META PIXEL, GOOGLE TAG MANAGER, AND GOOGLE ANALYTICS
Our website uses cookies, tags, pixels, and similar technologies to operate the site, understand website usage, measure advertising performance, and support remarketing and other digital marketing activities.
Meta Pixel
We use the Meta Pixel to measure interactions with our website, attribute and evaluate advertising campaigns, and support remarketing where applicable. The Meta Pixel is implemented through Google Tag Manager. Our current Meta Pixel identifier is 2320790161769008.
Google Tag Manager
We use Google Tag Manager to manage website tags and integrations, including analytics and advertising technologies. Google Tag Manager is a tag-management layer; services deployed through it may collect information as described in this Policy.
Google Analytics 4
We use Google Analytics 4 (GA4) to understand website usage, traffic, interactions, and performance. GA4 may collect information such as device and browser information, approximate geographic information, session and usage information, and cookie or similar identifiers. TMF does not intend to configure Google Analytics to receive information that directly identifies you, such as the contents of a mortgage application or other sensitive financial information.
You can control or delete cookies through your browser settings. Where required by applicable law, TMF will provide appropriate consent and privacy controls for cookies and similar technologies.
9. REMARKETING AND ADVERTISING
We may use information collected through cookies, pixels, analytics, and similar technologies to measure and improve advertising campaigns and to create or support remarketing audiences. Advertising platforms may process certain information according to their own privacy policies and the settings or choices available through their services.
We do not use advertising technologies to sell mortgage leads to unrelated third parties. However, the use of advertising and analytics technologies may involve disclosure of certain website interaction, device, or online identifier information to the providers of those technologies. Where applicable law treats such disclosure as a “sale” or “sharing” of personal information for targeted or cross-context behavioral advertising, TMF will provide the privacy choices and opt-out rights required by law.
10. TELEPHONE, EMAIL, AND OTHER COMMUNICATIONS
If you provide your telephone number or email address, we may use it to respond to your inquiry, provide requested information, coordinate follow-up, or communicate about mortgage services and related matters.
TMF’s current lead follow-up process is human telephone contact. We do not currently use automated telephone calls or automated SMS messages as the initial lead follow-up method. Any consent required by applicable law for calls, texts, or other marketing communications will be obtained separately where required.
This Privacy Policy is not intended to serve as telephone or text-message consent. Where a form or landing page contains a separate consent disclosure, that disclosure governs the communications described in it.
11. DATA RETENTION
TMF does not currently use a single fixed deletion period for lead records in HubSpot. We may retain information for as long as reasonably necessary to respond to and manage an inquiry, maintain appropriate business and regulatory records, comply with legal obligations, resolve disputes, prevent fraud, protect our rights, and for other legitimate business purposes, subject to applicable law and our information retention and security practices.
Retention periods may vary depending on the nature and sensitivity of the information, whether a customer relationship is established, applicable legal or regulatory requirements, and whether continued retention is reasonably necessary for a legitimate business purpose.
12. INFORMATION SECURITY
TMF maintains administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, or destruction. Access to information is limited to personnel and service providers who have a legitimate business need to access it.
No method of transmission or storage is completely secure. Accordingly, we cannot guarantee absolute security of personal information. If a security incident occurs, TMF will respond in accordance with applicable law and regulatory requirements.
13. PRIVACY CHOICES AND STATE PRIVACY RIGHTS
Privacy laws vary by state and may provide residents with rights regarding personal information, including rights to access, correct, delete, obtain a copy of, or restrict certain uses of personal information, subject to applicable exceptions.
Depending on your state of residence and the nature of the information and relationship with TMF, certain financial information may also be subject to federal financial privacy laws, including the GLBA, that can limit or modify the application of state privacy rights.
To submit a privacy request, contact info@tmfnow.com. We may need to verify your identity before fulfilling a request. Where required by applicable law, TMF will provide additional methods or online mechanisms for submitting privacy requests and opt-out preferences, including recognition of legally valid opt-out preference signals.
California Residents
California law may provide California residents with additional rights, subject to applicable exemptions. These may include rights to know/access personal information, request correction or deletion, limit certain uses or disclosures of sensitive personal information, and opt out of certain sales or sharing of personal information for cross-context behavioral advertising.
TMF does not sell mortgage leads. However, our use of Meta Pixel, Google Analytics, remarketing, and related advertising technologies may involve disclosure of certain online identifiers or internet activity to advertising or analytics providers. Whether a particular disclosure constitutes “sale” or “sharing” under California law depends on the circumstances and applicable law.
Where TMF is subject to California opt-out requirements, TMF will honor legally valid opt-out preference signals, such as Global Privacy Control, and will provide any additional opt-out mechanism required by law.
California residents may submit privacy requests by contacting info@tmfnow.com. We will not discriminate against you for exercising a privacy right provided by applicable law.
14. GLBA / FINANCIAL PRIVACY
Because TMF provides mortgage-related financial services, certain personal financial information may be subject to the Gramm-Leach-Bliley Act and its implementing regulations, including Regulation P, where applicable.
This Website Privacy Policy describes TMF’s website and digital-data practices. It does not necessarily replace a separate GLBA privacy notice that TMF may be required to provide to consumers or customers. Where a separate GLBA privacy notice, opt-out notice, or other financial privacy disclosure is required, TMF will provide it in accordance with applicable law.
TMF may disclose nonpublic personal information to service providers and other parties as permitted or required by applicable law, including disclosures necessary to process or administer transactions, maintain accounts or records, protect security, prevent fraud, comply with legal requirements, or perform services on TMF’s behalf.
15. CHILDREN’S PRIVACY
Our website and mortgage services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 for the purpose of providing mortgage services. If you believe a child has provided personal information to us, please contact us at info@tmfnow.com.
16. THIRD-PARTY WEBSITES AND SERVICES
Our website or communications may contain links to third-party websites or services. We are not responsible for the privacy practices, content, or security of third parties. We encourage you to review the privacy policies of third-party services before providing them with personal information.
17. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, services, or legal and regulatory requirements. The “Last Updated” date at the top of this Policy indicates when it was most recently revised. Material changes will be posted on this page or communicated as required by applicable law.
